1. Introduction and acceptance

Welcome to Dal Sahota Therapies and Mental Health Training (the Company, we, us, our). These Terms of Use (Terms) apply to your use of our websites, and to every product, course, training program, therapy service and appointment you purchase or book from us, whether through our websites, a booking form, an invoice, or by email.

By accessing our websites, making a purchase, submitting a booking form, paying an invoice or confirming a booking by email, you agree to these Terms, our Refund and Returns Policy and our Privacy Policy in full. If you do not agree, you must not use our websites or services.

2. Definitions

  • Company means Dal Sahota Therapies and Mental Health Training, operating www.dalsahota.com and www.mentalhealthresourcehub.com.
  • You means any visitor, customer, client, student or participant who uses our websites or purchases or books any product or service.
  • Digital Product means any downloadable or online content, including audio tools, workbooks, guides, templates and resources.
  • Online Programme means any self-paced online course or programme accessed through our websites or learning platform.
  • Live Service means any service delivered at a scheduled time, including MHFA courses, in-person training, and therapy and hypnotherapy appointments.
  • MHFA Australia means Mental Health First Aid Australia, the national licensing body for Mental Health First Aid courses.
  • Business day means Monday to Friday, excluding Western Australian public holidays.

3. Use of our websites

  • You must be at least 18 years old, or have the consent of a parent or guardian, to use our websites or purchase our services.
  • You must use our websites lawfully. You must not disrupt their operation, attempt unauthorised access to any part of them, or use them for any unlawful purpose.
  • Information on our websites is general in nature and is provided for educational purposes only.

4. Intellectual property

  • All content on our websites and in our products and services, including text, audio, video, workbooks, slides, handouts, recordings and training materials, is owned by the Company or used under licence and is protected by copyright.
  • You may not copy, reproduce, record, distribute, modify, share, publish or resell any content without our prior written permission. Screen recording or recording of any live session is not permitted.
  • MHFA course materials are the intellectual property of MHFA Australia and are used under licence.
  • Unauthorised use may result in immediate termination of your access without refund and may result in legal action.

5. Digital products and online programmes

  • All purchases of Digital Products and Online Programmes are final and non-refundable, except where a refund is required under the Australian Consumer Law. See our Refund and Returns Policy.
  • Access is granted for your personal use only. You must not share login details, distribute content, or resell or repackage any material.
  • Access periods for Online Programmes are stated at the time of purchase. Extensions are at our discretion.
  • Prices are displayed in the currency shown at checkout. Your bank or card provider will convert the amount if you pay in another currency, and any conversion fees are your responsibility.
  • We may revoke access without refund if you breach these Terms.

6. General booking terms for all live services

This clause applies to every Live Service. Clauses 7, 8 and 9 add further terms for MHFA courses, in-person training and therapy appointments respectively. If there is any inconsistency, the service-specific clause applies.

6.1 Booking and payment

  • All fees are payable in full at the time of booking. A place or appointment is confirmed only once payment has been received in full. Where an invoice is requested, your place is held only once the invoice has been paid. Unpaid invoices do not secure a place.
  • All prices are in Australian dollars unless stated otherwise. GST applies where stated.
  • You must provide accurate contact details at the time of booking and keep them up to date.

6.2 Notice if you cannot attend

  • If you cannot attend a booked session or appointment you must notify us in writing by email to dal@dalsahota.com within the notice period for that service. For MHFA courses and in-person training the notice period is three (3) business days before the scheduled start time. For therapy and hypnotherapy appointments it is two (2) business days (48 hours) before the appointment time.
  • Notice given by any other means, including text message, social media, messaging apps or voicemail, is not valid notice.
  • Notice periods exist because your attendance affects whether a course can proceed for other participants, and because appointment times cannot be offered to another client at short notice.

6.3 Transfers with notice

  • If you give the required notice, you may transfer to another available date or time once at no additional charge, subject to availability. For courses, the new date must fall within three months of your original booking date.
  • Any further transfer, and any transfer outside the period above, is treated as a new booking and the full current fee applies.

6.4 Non-attendance and late notice

  • If you do not attend, or give less than the required notice, your booking or appointment is forfeited in full. No refund, credit or transfer is provided. If you wish to attend later you must make and pay for a new booking at the current price.
  • Arriving after the scheduled start time, leaving before the end, or failing to meet the participation requirements for the service is treated as non-attendance.

6.5 Booking validity

  • Every course booking must be completed within three months of the booking date. A booking not completed within this period lapses and is forfeited in full.

6.6 Rescheduling by the Company

  • If we need to reschedule a session or appointment, including because a minimum number of participants has not been met, because of illness, or for any reason outside our reasonable control, you will be moved to the next available date or time. This does not entitle you to a refund. Where we reschedule a course, your three month booking validity is extended by the length of the delay.

6.7 Communication

  • All communication about your booking is by email to and from dal@dalsahota.com. You are responsible for checking your inbox and spam or junk folders.
  • We are a one person business. Emails are answered in business hours and a response may take up to two business days.

6.8 Conduct

  • We may remove any participant whose behaviour is disruptive, abusive or unsafe, without refund.

7. Mental Health First Aid (MHFA) courses

7.1 Who you are booking with

  • Your booking is made directly with Dal Sahota, an independent instructor licensed by MHFA Australia. It is not a booking with MHFA Australia.
  • MHFA instructors are independent business owners. We do not work for MHFA Australia, do not act on its behalf, and have no access to its systems, records or accreditation register.
  • Requests for accreditation extensions, technical problems with the MHFA Australia platform, and questions about the national MHFAider register must be directed to MHFA Australia at mhfa@mhfa.com.au or +61 3 9079 0200.
  • MHFA courses are governed by MHFA Australia’s national policies, which apply to every instructor and participant and which we cannot vary.

7.2 Course structure and attendance requirements

  • Blended online courses have two components. Component 1 is self-paced eLearning provided by MHFA Australia. Component 2 is live Zoom sessions delivered by the instructor. All eLearning must be completed in full before you can attend the Zoom sessions. Refresher courses have no eLearning component.
  • You must attend every session in full, from the scheduled start time to the end, with your camera on and in a private space where you can participate. These are MHFA Australia requirements for accreditation and we cannot waive them.
  • Late entry is not permitted. Joining after the scheduled start time, leaving early, or not meeting the participation requirements is treated as non-attendance under clause 6.4.
  • Calendar invitations containing the Zoom link are sent after payment has been received and, for blended courses, after you have confirmed by email that your eLearning is complete. You must accept the invitation to confirm your attendance.

7.3 Fees set by MHFA Australia

  • The course fee includes the instructor’s delivery fee and fees set and collected by MHFA Australia, currently the eLearning voucher (blended courses) and the Learner Access Pass. MHFA Australia’s fees are passed on at cost, are non-refundable, and may be changed by MHFA Australia at any time without notice.
  • If MHFA Australia increases a fee or introduces a new fee before you have completed your course, the difference is payable by you before you can attend.
  • eLearning vouchers and Learner Access Passes are purchased from MHFA Australia on your behalf after booking. Once purchased or assigned, the cost has been incurred and cannot be refunded for any reason.

7.4 eLearning validity

  • MHFA Australia eLearning access is valid for three months from the date it is assigned to you. We cannot extend it.
  • If your eLearning expires before you complete the course, you must purchase a new eLearning voucher, and a new Learner Access Pass where MHFA Australia requires one, at the current MHFA Australia price before you can attend.

7.5 Minimum numbers

  • MHFA Australia requires between six and twelve confirmed participants for a public course to proceed. A confirmed participant is one who has paid in full and, for blended courses, completed the eLearning.
  • If fewer than six participants are confirmed, the course will be rescheduled and you will be moved to the next available date under clause 6.6. We will do our best to run your preferred date but cannot guarantee any public course date until the minimum number is confirmed.

7.6 Accreditation

  • MHFA accreditation is issued by MHFA Australia, not by us, after you have completed the eLearning (where applicable) and attended every session in full. The instructor records your attendance with MHFA Australia after the final session.
  • For refresher courses you must hold current MHFA accreditation on the date of the course. If your accreditation has expired you must obtain an extension from MHFA Australia before booking. We cannot request extensions on your behalf and cannot refund a refresher booking made with expired accreditation.
  • You are responsible for providing the correct name, email address and accreditation expiry date at the time of booking.

7.7 Substitution

  • Substitution of another person from the same organisation may be permitted at our discretion if requested in writing at least three business days before the session. Once an eLearning voucher has been assigned to a named participant it cannot be transferred.

7.8 Expressions of interest

  • Submitting an expression of interest through the MHFA Australia website does not create a booking. A place is secured only by payment. Once you have our direct email address, please do not submit further expressions of interest for the same booking, as this creates duplicate records.

8. In-person and organisational training

  • Bookings for in-person training and organisational (in-house) training are confirmed once a written quote or booking form has been accepted and payment, or the deposit stated in the quote, has been received.
  • The notice period for cancellation or rescheduling by the client is three business days before the training date, or the longer period stated in the quote. Cancellation or rescheduling with less notice forfeits the full fee.
  • Where the client cancels with the required notice, one free transfer to another available date within three months is permitted. Further changes are treated as a new booking.
  • For MHFA courses delivered in-house, clause 7 also applies. Any MHFA Australia fees already incurred for named participants are non-refundable.
  • Substitution of a participant from the same organisation may be permitted if approved in writing before the training date and before any eLearning has been assigned.
  • Travel, accommodation and venue costs stated in the quote are payable by the client and are non-refundable once incurred.
  • The client is responsible for providing a suitable venue, equipment and access as agreed in the quote.

9. Therapy and hypnotherapy appointments

  • Appointments are confirmed once payment has been received or an appointment has been confirmed by email.
  • The notice period for cancelling or rescheduling an appointment is two business days (48 hours) before the appointment time. Appointments cancelled or rescheduled with less notice, and missed appointments, are charged in full.
  • If you are late, the appointment will end at the scheduled time and the full fee applies. If you have not joined or arrived within 15 minutes of the start time the appointment is treated as missed.
  • Therapy and hypnotherapy are not emergency services. If you are in crisis or at risk of harm, contact emergency services on 000, Lifeline on 13 11 14, or your nearest hospital emergency department.
  • Hypno-psychotherapy and related services are complementary to, and not a substitute for, medical or psychiatric care. You should continue to consult your doctor about any medical condition and any medication.
  • Where a private health fund rebate is available, you are responsible for claiming it. Rebates are determined by your fund and are not guaranteed by us.
  • Programmes made up of multiple sessions are purchased as a package. Sessions must be used within the period stated at purchase, and unused sessions are not refundable.

10. Disclaimer and limitation of liability

  • All content, courses, training and resources are provided for educational purposes only. They do not constitute medical, psychological or psychiatric advice and are not a substitute for professional care tailored to your circumstances.
  • No outcome or result is guaranteed from any product, course, training or therapy service.
  • To the fullest extent permitted by law, the Company is not liable for any loss, damage, injury, cost or expense arising from your use of our websites, products or services, or from any decision you make based on them.
  • Where liability cannot be excluded under the Australian Consumer Law, our liability is limited, at our option, to resupplying the service or paying the cost of resupply.

11. Privacy

Your personal information is handled in accordance with our Privacy Policy. Information you provide when booking an MHFA course is shared with MHFA Australia as required to assign eLearning and record accreditation.

12. Third party links and services

Our websites and communications may link to third party websites and services, including MHFA Australia, payment providers, booking platforms and video conferencing tools. We are not responsible for their content, availability, privacy practices or accuracy.

13. Payment disputes and chargebacks

  • If you lodge a chargeback or payment dispute after receiving access to a Digital Product, Online Programme, eLearning or training, all access will be cancelled immediately and full evidence of purchase, access, delivery and communication will be provided to the relevant financial institution.
  • A genuine duplicate payment made in error will be refunded once verified.

14. Termination of access

We may suspend or terminate your access to our websites, products or services immediately and without refund if you breach these Terms, including by sharing content, infringing intellectual property, or behaving in a disruptive, abusive or unsafe way.

15. Australian Consumer Law

Nothing in these Terms or in our Refund and Returns Policy excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Refunds are not provided for change of mind, personal circumstances, workload, illness, non-attendance or failure to complete a course within its validity period.

16. Changes to these Terms

We may update these Terms at any time by publishing the updated version on our website. The Terms in force on the date you book or purchase apply to that booking or purchase. Changes to MHFA Australia policies and fees apply as set out in clause 7 regardless of your booking date.

17. Governing law

These Terms are governed by the laws of Western Australia. Any dispute will be dealt with in the courts of Western Australia.
